BarFinder Terms of Use

Welcome to BarFinder ("BarFinder," "we," "us," or "our"), a website and application that helps people discover bars, breweries, wineries, distilleries, and other nightlife venues ("Venues"), along with related content such as drinks, events, and bands/DJs. These Terms of Use ("Terms") are a legal agreement between you and TandT Solutions LLC ("Company") and govern your access to and use of barfinder.com and any associated apps (collectively, the "Service").

By creating an account, browsing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Age Requirement

BarFinder's content is centered on alcohol and nightlife venues. By using the Service, you represent that:

We may ask you to verify your age and may suspend or terminate accounts we reasonably believe belong to underage users.

• You are at least 21 years old, or the legal drinking age in your jurisdiction if higher, or you are accessing informational content only and are of an age at which you may lawfully do so under the laws of your location.
• You are legally permitted to use the Service under the laws of your jurisdiction.
• If you create an account, you are providing accurate information and will keep it current.

2. No Affiliation With, or Endorsement By, Listed Businesses

BarFinder is an independent discovery and information platform. We are not owned by, operated by, affiliated with, sponsored by, or endorsed by any bar, brewery, winery, distillery, restaurant, band, DJ, or other business or entity listed, described, or referenced on the Service, unless a listing is explicitly and clearly marked as an official, verified, or "claimed" listing maintained directly by that business (see Section 8, "Business Claims").

Venue information (hours, addresses, phone numbers, photos, descriptions, tags, and similar details) is aggregated from a combination of public data sources, user submissions, and business-provided updates. We make reasonable efforts to keep this information accurate but do not guarantee its accuracy, completeness, or timeliness. Always confirm details such as hours of operation, age restrictions, dress codes, and current health/safety requirements directly with the venue before visiting.

Any trademarks, logos, or business names displayed on the Service belong to their respective owners and are used solely for identification and informational purposes (nominative use), not to imply endorsement, partnership, or affiliation.

3. No Endorsement of Drinking and Driving; Responsible Use

BarFinder does not encourage, endorse, promote, or condone excessive alcohol consumption, underage drinking, or driving under the influence of alcohol or any other substance. Content on the Service relating to bars, drinks, and nightlife is provided for informational and entertainment purposes only.

You are solely responsible for your own decisions regarding alcohol consumption and transportation. If you plan to drink, plan a safe way home in advance — for example, a designated driver, rideshare, taxi, or public transit. BarFinder is not a substitute for responsible planning, and we accept no responsibility or liability for decisions you make regarding alcohol consumption or transportation after using the Service.

If you or someone you know struggles with alcohol use, resources such as the SAMHSA National Helpline (1-800-662-4357, U.S.) are available 24/7.

4. Accounts

• You may need an account (via email/password or a supported third-party sign-in provider) to submit content, post reviews or comments, save favorites, claim a business, or use certain other features. Browsing venue listings does not require an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us promptly of any unauthorized use of your account.
• We may suspend or terminate your account at our discretion, with or without notice, for conduct that violates these Terms, is harmful to other users or third parties, or exposes us or others to liability.
• You may request deletion of your account at any time (see our Privacy Policy for how).

5. User-Submitted Content

The Service allows users to submit content, including but not limited to venue listings, reviews, star ratings, comments, photographs, drink recipes, band/DJ profiles, and reports ("User Content").

5.1 Ownership

You retain ownership of the User Content you submit. We do not claim ownership over your reviews, photos, comments, or other original contributions.

5.2 License Grant to BarFinder

By submitting User Content, you grant BarFinder a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and technical purposes only), publicly display, publicly perform, distribute, and create derivative works of your User Content, in connection with operating, promoting, and improving the Service — including displaying it on venue/band/drink pages, in search results, and in official BarFinder social media posts that showcase site activity (see Section 5.5). This license continues even if you stop using the Service, to the extent your User Content remains associated with other users' interactions with it (for example, a comment thread), but ends for content you delete, subject to standard technical retention (such as backups) and any content already shared with others.

5.3 Your Responsibilities

You represent and warrant that:

• You own or have the necessary rights to submit the User Content and grant the license above.
• Your User Content does not infringe any third party's intellectual property, privacy, or publicity rights.
• Your User Content is not false, defamatory, or misleading (for example, a review of an experience you did not actually have).

5.4 Prohibited Content and Conduct

You may not use the Service to submit, and we may remove, restrict, or take action (including suspending or terminating your account) against any User Content or conduct that:

We use a combination of automated checks and human review to moderate submitted content, but we are not obligated to monitor all content and are not responsible for User Content posted by others.

• Is illegal, fraudulent, or promotes illegal activity.
• Is defamatory, harassing, hateful, threatening, or discriminatory on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic.
• Is obscene, sexually explicit, or otherwise inappropriate for a general audience.
• Impersonates any person or entity, or misrepresents your affiliation with any person or entity (including a venue).
• Is spam, a scripted or automated submission, or otherwise abuses the Service's submission, comment, review, or report features (including attempts to circumvent rate limits or moderation).
• Contains malware or attempts to interfere with the Service's normal operation, security, or integrity.
• Infringes any third party's intellectual property or other rights.
• Discloses another person's private information without consent.
• Is a fake review, incentivized review not disclosed as such, or otherwise manipulates ratings or reviews.

5.5 Featuring Your Content

We may, at our discretion, feature or reference publicly-posted User Content (such as a venue photo or a highlight from a review) in BarFinder's own marketing, official social media accounts, or promotional materials, consistent with the license in Section 5.2. If you would prefer specific content not be featured this way, contact us and we will make reasonable efforts to accommodate the request going forward.

6. Prohibited Uses of the Service

In addition to the content rules above, you agree not to:

• Scrape, crawl, or harvest data from the Service using automated means, except as permitted by our robots.txt or with our prior written consent.
• Attempt to gain unauthorized access to any account, system, or network connected to the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law permits it.
• Use the Service to build a competing product or dataset without authorization.
• Interfere with or disrupt the integrity or performance of the Service (including its rate limits and anti-spam protections).
• Use the Service in violation of any applicable law or regulation.

7. Reviews, Reports, and Moderation

Reviews, comments, and "report an issue" submissions are moderated. We reserve the right, but not the obligation, to review, edit, remove, or decline to publish any User Content, and to act on reports at our discretion. Moderation decisions are made in good faith but are not guaranteed to be error-free; if you believe content was removed or retained in error, contact us.

8. Business Claims

Venues may be "claimed" by an authorized representative of that business through our claim process, which requires a stated justification and contact information and is reviewed by our team before approval. By submitting a claim, you represent that you are authorized to act on behalf of the business. Approving a claim grants the claiming account additional management capabilities over that venue's listing; we may revoke a claim at any time if we determine it was made in error, in bad faith, or without authorization, or if the venue's actual ownership changes.

A claimed listing is still not an endorsement by BarFinder of the business, and does not create any partnership, agency, joint venture, or employment relationship between BarFinder and the business.

9. Analytics and Tracking

We use analytics tools (including Google Analytics) and similar technologies to understand how the Service is used, measure performance, and improve our offering. See our [Privacy Policy](/privacy) for details on what is collected, how it's used, and your choices. By using the Service, you consent to this tracking as described there, to the extent required by applicable law.

10. Intellectual Property

Except for User Content, the Service — including its design, text, graphics, logos, and underlying software — is owned by BarFinder or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service itself without our prior written permission.

11. Third-Party Services and Links

The Service integrates with or links to third-party services (for example, Firebase for authentication, Google Maps or OpenStreetMap for mapping, Google Analytics, and social platforms like Facebook and X for sharing). We are not responsible for the content, policies, or practices of any third-party service. Your use of those services is governed by their own terms and privacy policies.

12. Disclaimers

THE SERVICE AND ALL CONTENT (INCLUDING VENUE INFORMATION AND USER CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT VENUE INFORMATION IS CURRENT OR ACCURATE.

YOU ASSUME ALL RISK ASSOCIATED WITH VISITING ANY VENUE LISTED ON THE SERVICE, INCLUDING RISKS RELATED TO ALCOHOL CONSUMPTION, TRANSPORTATION, AND PERSONAL SAFETY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARFINDER AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless BarFinder and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Sections of these Terms that by their nature should survive termination (including Sections 5.2, 12, 13, 14, and 16) will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as a banner on the Service or an email) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
